1. Introduction

Welcome to Simple Calories. These Terms of Service ("Terms") govern your use of the Simple Calories mobile application ("App") and its AI-powered food analysis features ("Services"). By downloading, installing, or using the App, you agree to be bound by these Terms.

2. Description of Service

Simple Calories is a calorie tracking application that helps users monitor their food intake. Our Pro subscription unlocks AI-powered camera features that analyze photos of your meals to help log nutritional information.

Free Features:

• Manual calorie tracking
• Food database access
• Basic meal logging
• Weight tracking

Pro Subscription Features:

• AI-powered food photo analysis
• Automatic calorie estimation from photos
• Enhanced meal recognition
• Unlimited AI camera scans

3. Subscription Terms

3.1 Auto-Renewable Subscription

The Pro subscription is an auto-renewable subscription that provides access to premium AI camera features.

3.2 Pricing and Payment

• Subscription pricing is displayed in the App and App Store
• Payment will be charged to your iTunes Account at confirmation of purchase
• All prices include applicable local sales taxes

3.3 Auto-Renewal Terms

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal cost will be the same as the initial subscription price unless we notify you in advance

3.4 Managing Your Subscription

• You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings after purchase
• No cancellation of the current subscription is allowed during the active subscription period
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

3.5 Subscription Cancellation

• You may cancel your subscription at any time through your Apple ID Account Settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to Pro features until the end of your paid period
• Refunds are handled according to Apple's refund policy

3.6 Changes to Subscription Pricing

• We reserve the right to modify subscription pricing at any time
• Price changes will be communicated in advance and will not affect your current billing period
• Continued use after a price change constitutes acceptance of the new price

4. User Accounts and Registration

4.1 Account Creation

• You may be required to create an account to access certain features
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials

4.2 Account Responsibility

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

• Nutritional information is approximate and should not be considered 100% accurate

• Information provided is for general wellness and tracking purposes only
• Do not rely solely on this App for medical nutrition therapy or dietary advice
• Consult with healthcare professionals for personalized dietary guidance
• The App should not be used to diagnose or treat any medical condition

5.3 User Responsibility

• You are responsible for verifying the accuracy of AI-generated nutritional information
• You should manually adjust entries as needed
• You are encouraged to use the AI results as a starting point, not as definitive data

6. Privacy and Data Usage

6.1 Photo Processing

• Photos taken with the AI camera are processed to analyze food content
• We do not store your food photos permanently unless you choose to save them
• Images are processed using third-party AI services - google gemini flash 2.5 model
• By using the AI camera, you consent to photo processing as described in our Privacy Policy

6.2 Data Collection

• We collect and use data as described in our Privacy Policy
• Your privacy is important to us and we are committed to protecting your personal information

7. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer or hack the App
• Share your account credentials with others
• Use the App to infringe on others' intellectual property rights
• Abuse or overload our systems
• Use automated systems or bots to access the App

8. Intellectual Property

8.1 Ownership

All content, features, and functionality of the App are owned by Simple Calories and are protected by copyright, trademark, and other intellectual property laws. The Simple Calories name, logo, and all related marks are our trademarks.

• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE PAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR HEALTH OUTCOMES RESULTING FROM USE OF THE APP

10. Indemnification

You agree to indemnify and hold harmless Simple Calories and its affiliates from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

11. Third-Party Services

The App may integrate with or contain links to third-party services:

• RevenueCat (subscription management)

• Apple App Store

Use of third-party services is subject to their respective terms and privacy policies.

12. Termination

The license granted is a non-transferable license to use the App on Apple-branded products you own or control as permitted by the Usage Rules in the App Store Terms of Service.

16.3 Maintenance and Support

Apple has no obligation to provide maintenance or support for the App.

16.4 Warranty

Apple is not responsible for any warranty claims related to the App.

16.5 Product Claims

Apple is not responsible for addressing any claims by you or third parties relating to the App.

16.6 Intellectual Property Claims

Apple is not responsible for investigating, defending, settling, or discharging any third-party intellectual property infringement claims.

16.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.
